Why rideshare cases are different
Uber and Lyft both maintain commercial liability insurance policies that kick in based on the driver's status in the app at the moment of the accident. That policy structure has three tiers:
- App off: the driver's personal auto insurance applies. Standard MVA case dynamics.
- App on, no ride accepted: a contingent liability policy of ~$50K/$100K applies if the driver's personal insurance doesn't cover.
- Ride accepted or passenger in vehicle: the full $1,000,000 commercial liability policy applies.
That $1M layer is the reason rideshare cases can be so valuable — but only if the driver's app-state at the time of the accident supports the claim.
Who the injured party can be
Rideshare accident leads come in three flavors, each with different case dynamics:
- Passenger in the rideshare vehicle — the cleanest case, typically covered by the full $1M policy.
- Driver of another vehicle hit by a rideshare driver — recovery depends on the rideshare driver's app-state at the moment of the accident.
- Pedestrian or cyclist struck by a rideshare vehicle — same app-state analysis as above.
What to spec when buying rideshare leads
Beyond standard PI qualifiers, rideshare-specific fields you should ask for on each lead:
- Was the injured party a passenger, another driver, or a pedestrian?
- Was the rideshare driver known to have a passenger at the time of the collision?
- Was the app in "ride accepted" or "picking up" mode?
- Company: Uber, Lyft, or other?
- Trip receipt / trip number if the injured party has it (passengers do; other drivers don't)?
Case values
Rideshare accident case values run higher than standard MVA on average because:
- The $1M policy layer means insurance won't be an underwriting limit on settlement.
- Corporate defendants (Uber, Lyft) settle faster to avoid PR risk.
- Passenger cases have almost no comparative-fault issue.
Pricing for rideshare leads
